We’re Pixelca Ltd, trading as Namecera (“we”, “us”, or “our”), a company registered in England and Wales (company number 13780748), 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. These Terms and Conditions (our “Terms”) form a legally binding agreement between you and us.
“You” (“your”, the “customer”, or the “user”) means any individual using our Services, including any employees, agents, contractors, or other persons accessing our Services with your authorisation.
“Services” means our website namecera.com and the sale of the domain names listed on it.
“Domain company” means the company you pay for a domain: Spaceship (including SafePay), Dynadot, GoDaddy or Atom (AtomPay).
By using our Services, you agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced within, which are expressly incorporated into these Terms. If you do not agree, you may not use our Services.
Our Services are intended for users aged 18 or older, or above the age of majority in their jurisdiction, whichever is higher. By using our Services, you confirm that:
Listings. Every domain on our site is owned by us. A listing, a price or a “Buy now” button is an invitation to buy, not a promise that the domain is still available. A domain can be sold elsewhere at any time, and prices can change.
How you pay. You never pay us directly. You pay a domain company, either through a Buy button on a domain page, through a checkout link we send you, or through a deal you start on SafePay or AtomPay. That company holds your payment, moves the domain into your account and only then pays us. Your purchase, your payment and any refund are covered by that company’s own terms, which you accept when you pay. The steps are explained on our Buying Process page.
Offers and checkout requests. An offer or a request you send us is not binding on either side. A sale is agreed only when we confirm a price to you in writing (for example by email) and you complete payment with a domain company. We may accept, counter or decline any offer.
Price errors. If a price on our site is clearly wrong, we may decline to sell at that price, even after you have started a checkout. If you have already paid, the domain company will handle the return of your payment under its terms.
After the transfer. Once the domain is in your account, you are its owner and are responsible for renewing it, its settings and how you use it.
Your use of the domain. You are responsible for checking that the domain is suitable for your plans, including whether any trademark or other rights could affect your use of it. Our descriptions and ideas for how a name could be used are suggestions only, and we do not promise any business result, search ranking or value.
By using our Services, you agree that you will not:
If you break these rules, we may block your access to our Services, decline to deal with you, and use any other legal remedies available to us.
We may change these Terms at any time by posting a new version on this page. The version in force when you agree a sale with us applies to that sale. Your continued use of our Services after a change means you accept the revised Terms.
Every clause in these Terms applies in full, except where a mandatory provision of applicable law requires otherwise. Nothing in these Terms limits, excludes, or modifies any mandatory rights, protections, or remedies you may have under the laws that apply to you.
We may update, change or remove listings and features of our website at any time. Our website may occasionally be unavailable because of maintenance, technical issues, or circumstances beyond our reasonable control. We are not liable for any loss arising from such interruptions, to the maximum extent permitted by applicable law.
We own, or are licensed to use, all intellectual property rights in our website, including its design, text, logos and images (“Materials”). Buying a domain from us transfers the domain name only; it does not give you any rights in our Materials, such as the logos or images we made to present the domain, unless we agree otherwise in writing.
You may refer to our company name and brand in a factual and truthful manner. You must not use our name, logo, or other brand assets in any way that implies endorsement, sponsorship, or affiliation with us without our prior written consent.
We respect the intellectual property rights of others. If you believe that content on our site, or a domain we list, infringes your rights, please contact us using the details at the end of these Terms, with full details of your claim.
If you send us feedback or suggestions, we may use them to improve our Services without any obligation to you. We will treat your offers and personal details as described in our Privacy Policy.
We aim to ensure that all information on our website is accurate and up to date. However, occasional errors, inaccuracies, or omissions may occur, including in prices, descriptions and sales data. We reserve the right to correct such errors at any time.
Our website links to third-party websites, including the domain companies where you pay. We do not control these websites and are not responsible for their content, availability or terms. When you use them, their own terms and privacy policies apply.
We will not be liable for any failure or delay in performing our obligations under these Terms that is caused by circumstances outside our reasonable control, such as natural disasters, internet outages, cyberattacks, strikes, or failures of third-party services, including the domain companies and domain registries.
Our website is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we make no warranties or representations of any kind about our website, express or implied, beyond those set out in these Terms. In particular, we do not warrant that our website will be uninterrupted or error-free.
The following limitations apply to the maximum extent permitted by applicable law.
We are not liable to you for any indirect or consequential loss, or for any loss of profits, revenue, business, goodwill, opportunity or data, arising out of or in connection with these Terms or your use of our Services.
Our total liability to you arising out of or in connection with these Terms or your use of our Services will not exceed the greater of (a) the price of the domain you bought from us, or (b) £100.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law.
You agree to indemnify us against all claims, losses, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or third-party rights, or your use of a domain you bought from us.
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales.
Before starting court proceedings, please first tell us about the dispute in writing using the contact details at the end of these Terms, with a description of the dispute and what you are asking for. We will try to resolve it informally within 30 days. If we cannot, either of us may go to court. The courts of England and Wales have jurisdiction, but if you are a consumer living elsewhere in the UK or in the EU, you may also bring proceedings in your local courts.
Disputes about a payment or a transfer made through a domain company may also be handled by that company’s own dispute process.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be removed to the extent necessary, and the remaining provisions shall remain in full force and effect.
If we do not enforce a right under these Terms straight away, we can still enforce it later.
These Terms, together with our Privacy Policy and any price we confirm to you in writing, form the agreement between you and us regarding our Services.
You may contact us at any time using the contact details at the end of these Terms. Where these Terms require notice in writing, email is sufficient.
You may not transfer your rights or obligations under these Terms to another person without our prior written consent. We may transfer our rights and obligations under these Terms to another company, for example if our business is sold; if we do so, your rights under these Terms will not be reduced.
In these Terms, “including” means “including but not limited to”. Headings are for convenience only and do not affect the interpretation of any provision.
